Respectful Outreach Code

DRAFT. Attorney review required. Research, not legal advice.

  1. Probate and heirship: wait at least 30 days after a filing before first contact (our voluntary policy, not a statute). Never contact anyone at a funeral, hospital, place of worship or court. Address mail to the court-appointed representative where one exists. Remember that estate property generally can't be sold without the authority the Estates Code requires (for example, a court order under §356.001 unless a will authorizes the sale). Never imply you can speed up probate or give legal advice.
  2. No calls or texts to numbers on the National Do Not Call Registry or the Texas no-call list unless an exemption truly applies. No autodialed, prerecorded or artificial-voice (including AI-voice) calls or texts without prior express written consent. Call only 8 a.m.–9 p.m. recipient local time. Make no more than 3 contact attempts per channel per person per 30 days. Stop immediately when asked.
  3. We do not provide skip-traced phone numbers. If you obtain phone numbers elsewhere, you alone are responsible for consent and Do Not Call compliance.
  4. Honor every opt-out, made by any reasonable means (for example "stop," "quit," "cancel," "unsubscribe," or a verbal request), right away and permanently, across all channels.
  5. Never misrepresent who you are, imply government or court affiliation, design mail to look like an official notice, or use threats or pressure. Never promise to stop a foreclosure or recover excess proceeds unless you comply with Texas Business & Commerce Code chapter 21.
  6. Never use this data as a factor in credit, insurance, employment, housing or tenant-screening decisions, or for any other purpose covered by the Fair Credit Reporting Act.
  7. Tenants in eviction cases: do not use eviction data to screen, rate or refuse anyone for housing.
  8. Comply with Texas telemarketing law: chapter 302 registration for non-consented solicitation calls and texts unless an exemption applies (the Texas Secretary of State says consent-based texts need no registration), the chapter 304 Texas no-call list, and chapter 305.
  9. Wholesalers: make the written equitable-interest disclosures under Property Code §5.0205 and Occupations Code §1101.0045 before assigning any contract.
  10. Licensed agents: include the license-holder and broker names required by TREC (22 TAC §535.155).
  11. Violations may lead to immediate suspension or termination without refund, and we may report unlawful conduct to authorities.
